Transcript of the Will of Robert Rowlands

I Robert Rowlands of Naunton in the County of Gloucester Tailor and Shopkeeper do hereby revoke all Wills by me heretofore made and do make this only for my last Will. I Give and bequeath unto my Dear Wife Hannah Rowlands All my stock in trade and implements of trade. I Give unto my son John Rowlands and my son in law David Lodge All my Household furniture books plate linen and china Upon trust that they permit my said Wife to use and enjoy the same during her life provided she continue unmarried And after her decease or marriage Upon trust for my four Children Mary Wilkins, Eliza Lodge, the said John Rowlands and Anna Maria Rowlands to whom I bequeath the same. I Give and devise unto my said Wife All my messuages lands and tenements situate at Naunton aforesaid and at Guyting Power in the said County and all the rest and residue of my real Estate to hold the same unto my said Wife during her life provided she continues unmarried and upon condition that she shall keep the said messuages and buildings in tenantable repair and insured from loss by fire. And after the decease or marriage of my said Wife I Give and devise the said messuages and other real estate in manner following that is to say I Give and devise unto my said daughter Mary Wilkins her heirs and assigns for ever all that Messuage with the Garden and outbuildings and appurtenances belonging thereto which I purchased of John Staite situate at Guyting Power aforesaid and now in the occupation of William Tery subject nevertheless to the proviso hereinafter contained. I Give and devise unto my said daughter Eliza Lodge her heirs and assigns for ever All that messuage with the Shop garden outbuildings and appurtenances in my own occupation and the Grates and other fixtures in and about the same and all that Cottage adjoining the same premises in the occupation of Robert Crook And all that garden at the top of Colts Lane and the orchard bought of William Green together with the road or way leading from the public Street to the Garden and premises at the rear of my dwelling house which road I purchased of the Reverend John Hurd all which last mentioned premises are situate at Naunton aforesaid. And also a right of road at all times hereafter along the passage which divides the premises in my occupation from those purchased of William Green hereinafter devised as it is now used and enjoyed jointly with the owner or occupier of the last mentioned premises. And also that Messuage with the Garden and appurtenances thereto situate at Naunton aforesaid in the occupation of Henry Hamblett subject nevertheless to and I hereby charge the hereditaments so devised to the said Eliza Lodge with the payment unto my Daughter Mary Wilkins yearly during her life for her sole and separate use independent of her present or any future husband of one annuity or clear yearly sum of Two pounds and ten shillings by equal quarterly payments commencing from the day of my Wife's decease And also subject to the proviso hereinafter contained. I Give and devise unto my said Son John Rowlands his heirs and assigns for ever all those five Cottages or tenements with the Gardens outbuildings and appurtenances situate at Guyting Power aforesaid and in the occupations of William Cook, John Smith, Joseph Clapton, William Troughton and James Butler I also Give to my said Son the sum of Fifty pounds. I Give and devise unto my said daughter Anna Maria Rowlands her heirs and assigns for ever All those four Messuages and tenements with the Gardens outbuildings and appurtenances thereto situate at Naunton aforesaid which I purchased of William Green and in the occupations of George Hughes, Joseph Sadler, James Hunt and George Townsend and also a right of road at all times hereafter along the said passage which divides the said premises from those in my occupation as it is now used and enjoyed jointly with the owner and occupier of the last mentioned premises. Provided always and it is my Will that my said three daughters or any or either of them shall not sell or dispose of the hereditaments to them respectively devised or any part thereof during the lives of my said trustees John Rowlands and David Lodge or the survivor of them without their or his consent in writing first obtained. I Give and bequeath all the rest and residue of my Estate and Effects real and personal of which I have power to dispose by Will unto the said John Rowlands and David Lodge their heirs executors administrators and assigns respectively Upon Trust that they and the survivor do and shall sell and convert the same into money and thereout pay my debts funeral and testamentary expences and the legacy hereby bequeathed and lay out the residue or surplus of such monies in the public funds and pay unto my said Wife the dividends thereof during her life and after her decease do and shall stand possessed of such monies Upon trust for the said Mary Wilkins Eliza Lodge John Rowlands and Anna Maria Rowlands in equal shares . And I appoint my said Wife and the said John Rowlands and David Lodge Executrix and Executors of my Will and direct that they shall not be answerable one for the other but each only for her and his own acts deeds and receipts and not for involuntary losses and that it shall be lawful for them to retain their necessary expences. In Witness whereof I the said Robert Rowlands the Testator have to this my last Will written on three sheets of paper set my hand to each sheet thereof on the Tenth day of January in the year of our Lord One thousand eight hundred and forty nine.

Appeared personally Hannah Rowlands of Naunton in the County of Gloucester Widow and David Lodge of Chadlington in the County of Oxford Farmer and alleged that these paperwritings contained the last Will of Robert Rowlands late of Naunton aforesaid Tailor and Shopkeeper deceased who died in the 11th day of January 1851. That they were the joint executors therein named That they would well and faithfully perform the Trusts thereof and pay the Debts of the deceased and render an Inventory and account when required That the Goods Chattels and Credits of the deceased were under the value of one hundred pounds and that he had no Leasehold Estate Wherefore they prayed probate
